8th FSM Congress Resolutions

Encouraging the sovereign nations of the world to recognize the government of the Republic of China.

Directing the President to decline the offer of a loan from the Government of the People's Republic of China for the reason that the restrictions imposed on the use of the funds are inconsistent with the National goals and priorities of the Federated States of Micronesia and constitute a serious affront and insult to the dignity of the Federated States of Micronesia as a sovereign and independent nation.

To ratify the "Treaty on the Non-Proliferation of Nuclear Weapons."

Inviting the President of the Federated States of Micronesia, His Excellency Bailey Olter, to address the Eight Congress of the Federated States of Micronesia in assembly.

Directing the Secretary of Finance to enforce the provisions of the Financial Management Act of 1979, as amended, in title 55 of the Code of the Federated States of Micronesia, and in particular those provisions, pursuant to section 225 thereof, that require allottees of funds to submit audit reports to the Congress and the President.

Calling for a moratorium on the licensing of any and all foreign fishing vessels, other than those have applications presently pending before the Micronesian Maritime Authority; for a reassessment of the national fishing industry, especially with regard to the area of enforcement of regulatory provisions in cooperation with neighboring countries; and for a review of the terms of existing agreements with foreign business entities engaged in fishing activities in the waters of the Exclusive Economic Zone of the Federated States of Micronesia, in order to improve the economic benefits to the nation and protect the environment.

Directing the Secretary of Finance to comply with article V of the Constitution of the Federated States of Micronesia in the exercise of his duties and the operation of the Department of Finance, giving due regard to the role and function of traditional leaders in Micronesian society generally and Pohnpei in particular, and to cease and desist from practices which fail to recognize or honor traditional leaders on Pohnpei according to the customs and traditions of the Pohnpeian people.

Modifying the sum of the total funds estimated to be available for appropriation from the General Fund of the Federated States of Micronesia for fiscal year 1995.

Approving the 1995 calendar year Tuberculosis Prevention and Control/Elimination Program grant application pursuant to section 210(2) of the title 55 of the Code of the Federated States of Micronesia.

Expressing the deep sorrow and profound sense of loss of the members of the Eight Congress of the Federated States of Micronesia at the sudden and untimely passing of the Honorable Senator Kalisto Refalopei, and conveying heartfelt condolences to the late Senator's family and to the people of Faichuuk.

Approving the fiscal year 1995 FSM Territorial Teacher Training Assistance Program grant application pursuant to section 210(2) of title 55 of the Code of the Federated States of Micronesia.

Requesting the President of the Federated States of Micronesia to advise the office of the Resident Representative of the United Nations Development Programmed (UNDP) for the Federated States of Micronesia of the Nation's great and continuing need for the expertise provided by the UNDP under the Water Resource and Assessment Development project, and to request that the program be extended an additional two years.

Confirming the nomination of Mr. Moses Santos as the National Election Commissioner for the State of Pohnpei of the Federated States of Micronesia.

Reaffirming the previous request of Congress that a special session be convened, upon a date and venue to be subsequently determined and announced bye the Presiding Officer.

To ratify the "Basel Convention on the Control of Trans boundary Movements of Hazardous Wastes and Their Disposal."

Approving the Goals 2000 State and Local Education System Improvement Program proposal pursuant to section 210(2) of the title 55 of the Code of the Federated States of Micronesia.

Approving the Kosrae Outward Bound Program grant application for the period of September 1, 1994, to August 31, 1995, pursuant to section 210(2) of title 55 of the Code of the Federated States of Micronesia.

Approving the School-to-Work grant application pursuant to section 210(2) of title 55 of the Code of the Federated States of Micronesia.

Approving the fiscal year 1995 grant application for Improving Health Outcomes in the FSM through Implementation of Nurse Practice pursuant to section 210(2) of title 55 of the Code of Federated States of Micronesia.

Approving, pursuant to section 210(2) of title 55 of the Code of the Federated States of Micronesia, the Kosrae road maintenance grant application to the United States Office of Territorial and Insular Affairs.

Approving, pursuant to section 210(2) of title 55 of the Code of the Federated States of Micronesia, the Kosrae Utilities Authority Start-up Program grant application to the United States Office of Territorial and Insular Affairs.

Approving, pursuant to section 210(2) of title 55 of the Code of the Federated States of Micronesia, the JTPA Presidential Coordination and Special Services Program grant application, for the period of July 1, 1994 through June 30, 1995.

Declaring the policy of the Congress of the Federated States of Micronesia to disapprove any future foreign fishing agreement where the access fee agreed upon between the Micronesian Maritime Authority and any foreign fishing company is less than fifteen percent of the value of the fish caught by that foreign fishing company per annum in the Exclusive Economic Zone of the Federated States of Micronesia.

Requesting the President of the Federated States of Micronesia to direct the appropriate members of his staff to release the funding appropriated and allocated by Public Law No. 8-75 earmarked for the Faichuk region.

Confirming the nomination of Mr. Bernard Helgenberger to the position of member of the Federated of Micronesia Telecommunications Corporation Board of Directors.

Calling for an investigation and review of the distribution and delivery of JTPA programs in Chuuk State, recommending the termination of the program director for negligence and dereliction of duty, and further recommending that the President and the FSM National Job Training Coordinating Council cause the Program in Chuuk State to effectively comply with the intent and objective of the Program.

Approving the calendar 1995 Pohnpei Community Health Center Program grant application pursuant to section 210(2) of title 55 of the Code of the Federated States of Micronesia.

Approving the Foreign Fishing Agreement Between the Micronesian Maritime Authority and the China National Fisheries Corporation.

Approving certain grant applications for funding under the Operating and Maintenance Improvement Program pursuant to section 210(2) of title 55 of the Code of the Federated States of Micronesia.

Directing the President, Attorney General, Secretary of Finance, and Public Auditor to conduct investigations into the activities of Ting Hong Oceanic Enterprises and further requesting the Micronesian Maritime Authority to cease issuing further fishing permits to vessels operated by Ting Hong until the investigations are completed.

Requesting that the FSM Department of External Affairs request the Secretary of the United States Department of Agriculture to continue funding development projects in the Federated States of Micronesia through the Farmers Home Administration ("FMHA").

Prescribing the method of distribution among the States of the goods and services received by the Federated States of Micronesia pursuant to the agreement between the Micronesian Maritime Authority and the Federation of Japan Tuna Fisheries Cooperative Associations.

Expressing deepest sympathy and condolences to the family and friends of the late Patricia Krause on the occasion of her untimely passing.

Requesting the Telecommunications Corporation of the Federated States of Micronesia to immediately commerce telecommunication broadcasting services within the Federated States of Micronesia.

Requesting that the Micronesian Maritime Authority immediately put into effect a moratorium on all foreign fishing activities in the Federated States of Micronesia and not renew any foreign fishing agreements, permits or licenses after their expiration.

Requesting the President of the Federated States of Micronesia to dismiss the FSM Budget Officer, Patrick Mackenzie, and the FSM Attorney General, Camillo Noket, for dereliction of duties.

Confirming the nomination of Lt. Governor Victor T. Edwin to the position of member of the Federated States of Micronesia Social Security Board of Directors.

To express the wishes of the Congress of the Federated States of Micronesia and to request and urge the President of the Federated States of Micronesia to investigate and explore possible solutions with the Secretary of the Interior, U.S. Department of Interior, for the decentralization of the administration of the Prior Service Benefits Program to appropriate local administrative authorities and the distribution of the Prior Service Benefits Trust Fund into separate Trust Funds under the Boards of those authorities.

Respectfully requesting the President of the Federated States of Micronesia to declare a moratorium on the National Government's participation in the ownership or management of joint venture fishing operations until the current joint venture operations in which the National Government participates are making a reasonable rate of return on our investment in such ventures and until sufficient infrastructure is available for such operations in all four States.

Ratifying the Arrangement on Accounting Procedures for the Agreement on Economic and Technical Cooperation between the Government of the People's Republic of China and the Government of the Federated States of Micronesia, "Loan Account No. 1".

Approving the Federated States of Micronesia Multidrug-Resistance Tuberculosis Laboratory Improvement Cooperative Agreement grant application for fiscal year 1993 pursuant to section 210(2) of title 55 of the Code of the Federated States of Micronesia.

Approving the Federated States of Micronesia Fixed Assets System Establishment Plan grant application for fiscal year 1994 pursuant to section 210(2) of title 55 of the Code of the Federated States of Micronesia.

To ratify the Vienna Convention for the Protection of the Ozone Layer pursuant to article IX, 2(b) of the Constitution of the Federated States of Micronesia.

To ratify the Articles of Agreement establishing the Arrangement for the Management of the Western Pacific Purse Seiner Fishery.

Approving the FSM Sexually Transmitted Disease Prevention and Control Program grant application extension for the grant period from January 1, 1993 through April 30, 1993 pursuant to section 210(2) of title 55 of the Code of the Federated States of Micronesia.

Approving the FY 1993 grant applications for the HIV/AIDS Surveillance Program and the HIV/AIDS Surveillance Program pursuant to section 210(2) of title 55 of the Code of the Federated States of Micronesia.

To ratify the Montreal Protocol on Substances that Deplete the Ozone Layer and its related amendments pursuant to article IX, section (2) (b) of the Constitution of the Federated States of Micronesia.

To ratify the Articles of Agreement establishing the International Monetary Fund, the International Monetary Fund, the International Bank for Reconstruction and Development, the International Finance Corporation, and the International Development Association, and to ratify the Conventions establishing the Multilateral Investment Guarantee Agency, and the International Centre for the Settlement of Investment Disputes.

Respectfully requesting the Government of the United States of America to conduct an audit of all CIP projects funded from grants provided under the Compact of Free Association for Chuuk State.

To ratify the Articles of Agreement of the Convention on Biological Diversity.

To ratify the Articles of Agreement establishing the United Nation Framework Convention on Climate Change.
